Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Specific provisions for consumers in the European Union (EU): The provisions of this section shall not limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence, or any other liability that cannot be excluded or limited under applicable law. Furthermore, all products purchased by consumers in the EU are covered by a statutory guarantee of conformity for a period of two years from the delivery of the goods. Your statutory rights as a consumer are not affected by these Terms.

SECTION 13 - RIGHT OF WITHDRAWAL FOR EU CONSUMERS This section applies only to consumers residing in the European Union.

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire physical possession of the goods.

To exercise the right of withdrawal, you must inform us (UAB Statoksa, Kareivių g. 19, LT-09133 Vilnius, Lithuania, email: metalcarwallart@gmail.com) of your decision by an unequivocal statement.

Effects of withdrawal: If you withdraw, we shall reimburse to you all payments received from you, including the costs of standard delivery. You shall send back the goods to Kolektyvo g. 163, 08314 Vilnius, Lithuania, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal. You will have to bear the direct cost of returning the goods.

Exceptions to the right of withdrawal: The right of withdrawal does not apply to contracts for the supply of goods that are made to the consumer's specifications or are clearly personalized.

SECTION 14 - INDEMNIFICATION You agree to indemnify, defend and hold harmless UAB Statoksa and our affiliates from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service.

SECTION 15 - GOVERNING LAW AND DISPUTE RESOLUTION These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of Lithuania.

For Users in the United States: Binding Arbitration and Class Action Waiver. Any dispute, claim or controversy arising out of or relating to these Terms shall be determined by binding arbitration in Wilmington, Delaware, before one arbitrator. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures. You agree that any arbitration will be conducted in your individual capacity only and not as a class action or other representative action. You expressly waive your right to file a class action or seek relief on a class basis.

For Consumers in the European Union: Dispute Resolution. The choice of governing law does not deprive you of the protection afforded to you by mandatory provisions of the law of your country of residence. Furthermore, the European Commission provides for an online dispute resolution (ODR) platform, which you can access here: http://ec.europa.eu/consumers/odr/.

SECTION 16 - SEVERABILITY, TERMINATION, AND ENTIRE AGREEMENT If any provision of these Terms is determined to be unlawful, the remaining provisions will remain in effect. These Terms are effective unless and until terminated by either you or us. These Terms of Service constitute the entire agreement and understanding between you and us.
